Terms & Conditions

Effective Date: October 25, 2026

These Terms and Conditions (“Terms”) govern your access to and use of the Muse Mind Therapy website, musemindtherapy.com (the “Website”), operated by Xiomara Morales, Licensed Marriage and Family Therapist (LMFT), California License No. 163670 (“I,” “me,” or “my practice”).

By accessing or using this Website, yu agree to these Terms. If you do not agree, please discontinue use of the Website.

1. Informational Purposes Only

The Website and its content, including articles, resources, service descriptions, and other materials, are provided for general informational and educational purposes only. The content is not psychotherapy, counseling, medical advice, diagnosis, or treatment, and it is not a substitute for individualized care from a qualified healthcare professional.

Although the Website discusses psychotherapy, trauma-informed care, EMDR, mindfulness, and holistic wellness, the information provided does not establish a therapeutic relationship or guarantee any particular outcome.

Contacting me through the Website, email, telephone, a scheduling platform, or social media, or participating in an initial consultation, does not by itself establish a therapist-client relationship. A therapeutic relationship is established only after the practice has accepted you as a client and the applicable intake, informed consent, and treatment documentation have been completed.

2. Emergency and Crisis Resources

Muse Mind Therapy does not provide emergency or crisis services through this Website. Website messages, emails, and other electronic communications are not monitored continuously and should not be used to request urgent assistance.

If you are experiencing a mental health crisis, call or text 988 to reach the Suicide & Crisis Lifeline. If you or another person is in immediate danger, call 911 or go to the nearest emergency department.

Do not rely on this Website or its communication channels for emergency assistance.

3. Eligibility and Permitted Use

This Website is intended for individuals aged 18 and older. By using the Website, you represent that you are at least 18 years old and have the legal capacity to agree to these Terms.

You agree to use the Website only for lawful purposes. You may not:

  • Use the Website in violation of any applicable law or regulation.

  • Attempt to gain unauthorized access to the Website, its systems, or associated data.

  • Interfere with the Website's operation, security, or availability.

  • Upload or transmit malicious code or content intended to harm the Website or its users.

  • Copy, misuse, or infringe upon the intellectual property or other rights of the practice or third parties.

I reserve the right to modify, suspend, or discontinue any portion of the Website, subject to applicable law.

4. Therapy Services and Professional Scope

Muse Mind Therapy provides psychotherapy services within the scope of my California LMFT license and applicable laws and regulations. Information on this Website is not a guarantee that a particular service, modality, appointment, or treatment approach will be appropriate or available for every individual.

Psychotherapy services are subject to separate intake requirements, informed consent, professional disclosures, and applicable practice policies. Those documents govern the therapeutic relationship and clinical services when you become a client.

Information about holistic or integrative wellness approaches is provided for informational purposes. Such descriptions do not replace the informed consent process or change the professional scope of services provided under my LMFT license.

5. Scheduling and Third-Party Services

The Website may link to third-party platforms used for scheduling, appointment management, insurance-related services, or professional directories, including Headway, SimplePractice, and Psychology Today, where applicable.

These services are operated by independent third parties and may be subject to their own terms, privacy policies, and security practices. I do not control third-party platforms and cannot guarantee their availability, accuracy, or uninterrupted operation.

Using a third-party scheduling platform does not, by itself, establish a therapist-client relationship or guarantee that an appointment or service will be accepted or provided.

Scheduling, cancellation, payment, insurance, and other client-service policies are governed by the applicable disclosures, agreements, and policies provided through the practice or the relevant platform.

6. Privacy and Confidentiality

Your use of this Website is also subject to the practice's Privacy Policy, which describes applicable website data collection, use, and disclosure practices.

Please do not submit sensitive personal information, detailed mental health histories, or confidential clinical information through general website forms, social media, or unsecured email.

Communications through the Website do not automatically receive the same protections or handling as communications made through designated clinical systems. No method of electronic communication can be guaranteed completely secure.

If you become a client, your protected health information will be handled in accordance with applicable privacy laws, including HIPAA when applicable, and the practice's Notice of Privacy Practices.

The Website Privacy Policy and the Notice of Privacy Practices serve different purposes and should be reviewed separately.

7. Intellectual Property

Unless otherwise indicated, the Website's original content, including text, graphics, logos, photographs, design elements, and other materials, belongs to Muse Mind Therapy or its respective licensors and may be protected by copyright, trademark, and other intellectual property laws.

You may access and use the Website for personal, noncommercial purposes. You may not reproduce, distribute, modify, publish, sell, or commercially exploit Website content without prior written permission, except where permitted by law.

All third-party names, logos, and trademarks remain the property of their respective owners. Their appearance on the Website does not necessarily imply endorsement, sponsorship, or affiliation.

8. Third-Party Links and Resources

The Website may contain links to external websites, educational resources, professional directories, or other third-party services.

These links are provided for convenience and informational purposes. I do not control or guarantee the accuracy, availability, security, or privacy practices of external websites. Inclusion of a link does not constitute an endorsement unless expressly stated.

Your use of third-party websites is subject to their respective terms and policies.

9. Website Availability and Disclaimer of Warranties

I make reasonable efforts to maintain useful and accurate Website content. However, the Website and its materials are provided on an “as is” and “as available” basis to the extent permitted by law.

I do not guarantee that the Website will always be available, uninterrupted, error-free, current, or free of technical issues. Information may change without notice, and errors or omissions may occur.

To the extent permitted by applicable law, I disclaim warranties that may otherwise apply to the Website, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

Nothing in these Terms excludes a warranty or protection that cannot lawfully be excluded under applicable law.

10. Limitation of Liability

To the extent permitted by applicable law, I am not responsible for losses or damages arising solely from your inability to access or use the Website, reliance on general informational content, or use of third-party websites and services.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by law, including liability for intentional misconduct or other conduct for which California law does not permit a limitation.

These Terms do not waive or restrict any rights or remedies you may have under applicable consumer protection laws or other nonwaivable legal protections.

11. Changes to the Website and These Terms

I may update the Website or revise these Terms from time to time. The effective date at the top of this page will reflect the date of the most recent revision.

Changes will become effective when posted unless applicable law requires otherwise. Your continued use of the Website after revised Terms are posted indicates your acceptance of the revised Terms to the extent permitted by law.

If you do not agree with a revision, you should discontinue use of the Website.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute concerning these Terms will be handled in a court with appropriate jurisdiction, subject to applicable law and any mandatory venue or consumer protection requirements.

Nothing in this section prevents you from exercising a legal right to bring a claim in another forum when applicable law permits or requires it.

13. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective to the extent permitted by law.

These Terms and the Website Privacy Policy govern your use of the Website. They do not replace or modify any separate informed consent, treatment agreement, Notice of Privacy Practices, or other agreement governing psychotherapy services.

A failure to enforce a provision does not constitute a waiver of the right to enforce that provision later.
